Terms of Service

1. The Service

Nabad is a real-time audience polling platform that lets presenters create live polls and participants respond instantly from any device. It is operated by Scarlett Myriam Jebara, Montréal, Québec, Canada ("we", "us", "our").

We offer a Free plan and paid subscription plans. Features differ between plans as described on the pricing page.

The Free plan is limited by the number of participants in one session, as stated on the pricing page. Creating multiple accounts, or using disposable email addresses, to get around the limits of the Free plan is not permitted, and we may suspend accounts used that way.

2. Accounts

You must provide a valid email address and keep your login credentials confidential. You are responsible for all activity that occurs under your account.

You must be at least 16 years old to create a host account. By registering, you confirm that you meet this requirement. Participants who join a session with a code need no account, and Nabad can be used with audiences of every age. A host who runs a session for minors is responsible for any consent their school, their organisation or the law requires.

3. Subscriptions and Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are in US dollars unless stated otherwise. Prices may change with 30 days' notice.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period: you keep access until then. We do not offer refunds for unused time except where required by applicable law.

Payments are processed by Stripe. We do not store your payment card details.

4. Acceptable Use

You agree not to use Nabad to:

• Post or transmit unlawful, harmful, harassing, or abusive content
• Violate the intellectual property rights of others
• Attempt to reverse-engineer, scrape, or disrupt the service
• Create accounts by automated means or under false pretences
• Use the service for spam or unsolicited communications

We may suspend or terminate accounts that violate these rules.

5. Your Content

You retain ownership of the poll questions, options, and responses you create. By using Nabad, you grant us a limited licence to store and display that content solely to provide the service to you.

You are responsible for ensuring your content does not violate any applicable laws or third-party rights.

6. Copyright and Intellectual Property

Copyright in the Nabad software, its design, and the text and images on this site is owned by Scarlett Myriam Jebara, of Montréal, Québec, Canada. Copyright arises automatically on creation under the Copyright Act (Canada) and is recognised internationally under the Berne Convention, with no registration or notice required for it to exist. Nothing in these terms transfers any of it to you.

Nabad is built on third-party open-source components, which remain the property of their respective authors and are used under their own licences. This section claims nothing over them.

"Nabad" and the Nabad logo are unregistered trade-marks of Scarlett Myriam Jebara, used in commerce in Canada. You may refer to Nabad by name to describe or link to the service. You may not use the name or logo in a way that suggests endorsement or affiliation.

7. Availability and Changes

We aim to keep Nabad available around the clock but do not guarantee uninterrupted access. We may perform maintenance, add or remove features, or change pricing at any time.

We will give reasonable notice of material changes where practicable.

8. Disclaimer of Warranties

Nabad is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the service will be error-free, secure, or continuously available.

9. Limitation of Liability

To the fullest extent permitted by law, Nabad and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or USD 50, whichever is greater.

Nothing in these terms limits rights you have as a consumer that cannot be excluded by contract, including under Quebec’s Consumer Protection Act.

10. Termination

You may delete your account at any time. We may suspend or terminate your account if you breach these terms, with or without notice depending on the severity.

On termination, your right to use Nabad ceases immediately. We may delete your data after a reasonable retention period.

11. Governing Law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. We will first try to settle any dispute in good faith by email. If that fails, the courts of the judicial district of Montréal have jurisdiction, unless the law gives you, as a consumer, the right to go to the courts where you live.

12. Changes to These Terms

We may update these terms from time to time. We will notify registered users by email or in-app notice at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.
